Terms & Conditions

1. Definitions

  • 1.1 Client means person, firm or company that purchases or agrees to purchase goods or services from the company.
  • 1.2 Company means Inventive Hosting.
  • 1.3 Goods or Services means the item supplied by the company as specified on the order form.
  • 1.4 Contract means a contract for the supply of goods and services by Inventive Hosting.

2. Terms & Conditions

  • 2.1 These terms and conditions apply to all contracts for the sale and supply of goods and services by Inventive Hosting to the exclusion of all other terms and conditions which the client may purport to apply.
  • 2.2 By completing the order form, orders by the mode of telephone or logging into your account/ uploading files the client will be deemed to have accepted and agreed to these terms and conditions.
  • 2.3 Any variation of the terms and conditions shall be inapplicable unless agreed in writing by the company.
  • 2.4 We the company reserve the right to amend and update these terms and conditions at anytime without notice.

3. Supply

  • 3.1 The company agrees to provide the service('s) to the client to the extent described in the client agreement from and according to the terms and conditions of this contract. The service level shall be deemed incorporated in to this contract.
  • 3.2 If the client's bandwidth or processor usage reaches the point where it has an adverse affect on other clients we the company reserve the right to disable services until you can reduce your usage.
  • 3.3 Each account includes a set amount of bandwidth, if you use more than this amount then you agree to pay for this bandwidth at a the rate of £1 per 1Gb of usage.
  • 3.4 The company cannot guarantee any level of service, although any problems will be solve as soon as possible.

4. Price & Payment

  • 4.1 Payment by the client will be either on a monthly or yearly basis.
  • 4.2 Payment is due each anniversary month or year following the date the account was established. Clients will automatically be charged again at the end of their period unless closure notification has already been given. Accounts are at risk for suspension of service if payment for hosting is not received 10 days after the due date.
  • 4.3 Payment on a monthly or yearly basis will be made via Paypal or Bank transfer.
  • 4.4 The company reserves the right to vary the amount payable (monthly or yearly) from time to time, however we will give you 30 days prior written notice of any such variation.
  • 4.5 We do not offer any form of credit to clients.
  • 4.6 If the client's service or account is activated before payment is made then payment must be sent in full.
  • 4.7 If payment is not made and received in full within 7 days from the completion of the agreement or after the renewal date, all technical support for the site will be revoked. If payment is still not made in the following 7-day period the client's account will be deleted from out servers and all DNS services will stop.

    Dedicated Server Accounts 15 days past due will be assessed a £50.00 late fee to re-activate service.

    VPS Accounts 5 days past due will be assessed a £10.00 late fee to re-activate service.
     
  • 4.8 Any returned cheques to clients will incur an administration fee of £10.00.
  • 4.9 The company has no obligation to carry out any work until full payment in advance has been received in clear funds.
     
  • 4.91 Dedicated Servers -

    All dedicated server and collocation server invoices will be generated by the 25th day of each month.

    All server invoices are due on the first of the month unless otherwise specified on your invoice.

    Invoices are considered as late after the 4th day of the month. After this date, past due clients will be subject to suspension and a £15.00 late fee will be applied.

    Suspensions will run between the 5th through the 7th day of each month. We avoid running suspensions over the weekend in order to avoid inconveniencing our clients with prolonged downtime.
     

5. Termination

  • 5.1 The initial term of this contract shall be the period described in the above and shall commence on the date of acceptance by the client. Thereafter the contract will continue on a monthly or yearly basis unless terminated according to the provisions below.
  • 5.2 Cancellations: Shared/Reseller/Dedicated/VPS/ Accounts - If you wish to cancel your services, Submit a cancellation request 7 days days prior to your renewal date. If your notice of cancellation is not received within this time frame, you will be liable for payment of the proceeding month and hereby agree to complete payment as invoiced accordingly.
  • 5.3 We the company reserve the right to cancel your account at anytime without notice.
  • 5.4 If your account is closed under 6.0, all files will be deleted you may or may not receive warning before hand.
  • 5.5 Any attempt to use the Control Panel for purposes other than its intended use will result in your account being. terminated.
  • 5.6 Any improper use by the client under any sections under 6.0 may result in immediate termination of the Company's service.
  • 5.7 If a client has ordered a service on an annual subscription the company expect the client to commit for this period of time. If the client wishes to cancel or breaks any of the terms and conditions and their account is cancelled within this service period, we the company will not make any refunds for any unused portions of the client's account. Whilst the company does not offer refunds the client have no obligation to continue using our service.

6. Improper Use

  • 6.1 The company's service may only be used for lawful purposes by the client.

    Our web hosting accounts shall not be used to distribute and store an unusual amount of multimedia files. Multimedia files are defined as any graphics, audio, and video files. An unusual amount refers to any web site with disk space usage for storing the multimedia files exceeding 70% of its total usage, either in terms of total size or number of files.

  • 6.2 Any breach of terms shall be deemed a material breach of this contract and shall entitle the company to terminate the contract irrelevant whether the client is aware of the content of any material so transmitted or not.
  • 6.3 We the company do not allow warez, File distribution/streaming websites for example a website distributing movies/music, software or MP3's, file backup storage. Pharmacy websites and websites selling both legal and illegal drugs are not allowed. Hosting banners or graphics or cgi scripts for other websites, Storing pages/files/data as a repository for other websites,  or IRC Bots. Inventive Hosting my be required by law to provide information to the police or other bodies if you are using your account to host or store illegal content
  • 6.4 Hacking 

    "Hacking" and related activities is prohibited. "Hacking" includes, but is not limited to, the following activities: illegally or without authorization accessing computers, accounts or networks, penetrating or attempting to penetrate security measures, port scans, stealth scans and other activities designed to assist in hacking.
  • 6.5 Export Control Violations 

    The exportation of encryption software outside of the United States and/or violations of United States law relating to the exportation of software is prohibited.
  • 6.6 Child Pornography 

    We do allow adult web content on our servers however the use of the Services to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. Inventive Hosting is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, the Services.
  • 6.7 Other Illegal Activities 

    The use of the Services to engage in any activities that are determined by Inventive Hosting, in its sole and absolute discretion, to be illegal is prohibited. Such illegal activities include, but are not limited to, storing, posting, displaying, transmitting or otherwise making available ponzi or pyramid schemes, fraudulently charging credit cards or displaying credit card information of third parties without their consent, and failure to comply with applicable online privacy laws. Inventive Hosting will cooperate fully with appropriate law enforcement agencies in connection with any and all illegal activities occurring on or through the Services.
  • 6.8 Obscene, Defamatory, Abusive or Threatening Language 

    Use of the Services to store, post, transmit, display or otherwise make available obscene, defamatory, harassing, abusive or threatening language is prohibited.
  • 6.9 Clients must not participate in any form of unsolicited bulk e-mailing or spam.
  • 6.10 Other Activities 

    Engaging in any activity that, in Inventive Hosting's sole and absolute discretion, disrupts, interferes with or is harmful to (or threatens to disrupt, interfere with or be harmful to) the Services, Inventive Hosting's business, operations, reputation, goodwill, customers and/or customer relations, or the ability of Inventive Hosting's customers to effectively use the Services is prohibited. Such prohibited activities include making available any program, product or service that is designed to or could be used to violate this Usage Policy. In addition, the failure by a Subscriber to cooperate with Inventive Hosting in correcting or preventing violations of this Usage Policy by, or that result from the activity of, a customer of the Subscriber is a violation of this Usage Policy.
  • 6.11 In general, Inventive Hosting does not monitor its customers' websites or activities to determine whether they are in compliance with this Usage Policy. However, when Inventive Hosting becomes aware of any violation of this Usage Policy or its User Agreement, Inventive Hosting may take any action to stop or correct such violation, including, but not limited to, shutting down a website, denying access to the Services or to the Internet, and/or removing information. In addition, Inventive Hosting may take action against a Subscriber or a customer of such Subscriber because of the activities of such customer. Inventive Hosting reserves the right to take any such action even though such action may affect other customers of the Subscriber.
  • 6.12 Clients may not store more data in their account than their allotted quota.
  • 6.13 Your account should use no more than 10% of the servers resources which may have a detrimental effect on other customers.
  • 6.14 Your web space may only be used for hosting web sites and files to be used with your web sites.
  • 6.15 Clients may not run server processes, such as talkers or IRC Bots from their login account.
  • 6.16 Clients may not use FTP usage for webcam broadcasting purposes.
  • 6.17 Any breach of the above provisions may result in an immediate withdraw of service provided by the company, warnings will be given first if possible to allow you to remove banned content.
  • 6.18 Inodes Accounts on any shared hosting account may not have an excessive number of inodes. Any account found to have over 100,000 inodes may be removed from our backup system to prevent overload. Any account seen to be exceeding 250,000 inodes is at risk for suspension. A warning will be sent and if no action is taken to resolve the issue, the account may be suspended. Every file on the account is counted as 1 inode. This includes mail as well as webpage content.
  • 6.19 Banned Scripts Inventive Hosting does not allow IRC server, IRC bots, or IRC shells to be operated on our network.

    We do not allow proxy servers or scripts, torrent trackers or torrent clients to be run from our shared/reseller hosting servers.
  • 6.20 Cron Jobs We allow customers to set up cron jobs to perform routine functions automatically. Any client who schedules cron jobs in such a manner that jobs take more then half the time to complete before the next scheduled iteration, and more frequently then 10 minutes is abusing the cron system. Any automated processes that excessively consume resources and impact server stability may be disabled at our discretion by our technicians.

7. Company's Liability

  • 7.1 In no circumstances whatsoever will the company be liable for economic, indirect or consequential loss arising from delays or service interruptions or data loss.
  • 7.2 The company will not be responsible for loss occasioned by computer viruses, whether introduced by the Company's software or otherwise.
  • 7.3 To protect your privacy we will not distribute your name or e-mail address to any third party.
  • 7.4 We the company reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Inventive Hosting do not allow Warez, Illegal MP3 websites on our servers
  • 7.5 We the company shall not be held liable for any loss or damage caused by the use, misuse, unavailability or removal of services.
  • 7.6 We the company shall not be held liable for any loss or damage caused by the use, misuse, unavailability or removal of services.

8. Client's Liability

  • 8.1 It is the client's responsibility to carry out computer virus precautions.
  • 8.2 Data stored on our servers is backed up. It is the responsibility of the client to keep independent backup files of important data. We the company cannot be held responsible for any loss incurred from the client's inability to backup any files.
  • 8.3 Telnet shell accounts are made available for editing and setting up your website. It is not a development platform for issues unrelated to your website.
  • 8.4 Clients must not leave their home directory at anytime
  • 8.5 Clients must not attempt to gain the privileges of another user.
  • 8.6 Any interference with the following files will result in your telnet access being removed -.bash_history - .bash_logout - .bash_profile - .bashvc
  • 8.7 Clients may have commercial use of web and ftp space. This privilege must not be abused. If the company believes that this or any other facilities have been abused by the client, this will result in an immediate termination of their account.
  • 8.8 Clients will be responsible for the content of their page/s including obtaining the legal permission for any works they include and ensuring that the contents of their page/s do not violate UK or any other laws that are applicable.
  • 8.9 The clients will be responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via their page/s
  • 8.10 When seeking domain registration, the client will be responsible when placing an order to ensure that the domain has not been registered by some other person.

9. Password Security

  • 9.1 The client will be given a login account, which is for personal use only. Clients must not divulge their password to any other people.
  • 9.2 The client shall taken reasonable precautions to ensure that it is not discovered by other people.
  • 9.3 The company reserves the right to change the password in the event of any suspected security breach.

Shared Hosting Resource Limits

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given an option of either paying extra for a dedicated server / semi-dedicated server (which depends on the resource needed) or reducing the resource used to an acceptable level. Inventive Hosting shall be the sole arbiter of what is considered to be a high server usage level. You agree to restrict your use of the shared hosting services to the direct serving of web content over the HTTP protocol. Misuses include, but are not limited to, scientific/grid/distributed computing, data warehouse/backup storage, and bandwidth sinks. We shall determine, in our sole discretion, what constitutes a misuse of the shared hosting services. If you are unsure of an application’s fitness for the shared hosting services, you should consult with us before using the Services in that manner.
